The last presidential election in our country and the way it was managed by the electoral umpire, the Independent National Electoral Commission, leaves behind unenviable precedents, which I believe the courts have a duty to redress. Our gains in ensuring transparent elections through the deployment of technology was heavily compromised by INEC in the way it managed the last presidential election, and I am afraid that the judgement of the court as rendered by the Presidential Election Petition Tribunal yesterday, failed to restore confidence in our dreams of free and fair elections devoid of human manipulations. Like I did say at the beginning of this legal battle when I instructed my lawyers to file my petition challenging the outcome of the presidential election, my ultimate goal in this pursuit is to ensure that democracy is further strengthened through the principles and processes of fair hearing.

Yet that same INEC undermined the use of that technology during the elections and collation process and declared as winner someone who clearly did not win the Presidential election. They then went further to take sides in the courts in a dogfight to defend their illegality. Who would convince the millions of Nigerians to vote in future elections after they suffered endlessly on queues to register to vote, to collect PVCs and to vote, based on INEC’s assurances only to see their votes stolen and given to someone they did not vote for? When people lose trust and confidence in elections, democracy is practically on life support. And by affirming and legitimizing the continued lack of transparency in our electoral system the courts are continuing to usurp the rights of voters to elect their leaders. The other grave implication is that contestants in Nigeria’s elections should do whatever is necessary to be declared the winner. That includes identity theft, impersonation, forging of educational and other documents, perjury, and violence.

The enthusiasm of Nigerians in the ongoing continuous voters registration of PVCs is commendable and indicative of the commitment of Nigerians to take their destinies in their hands in choosing their leaders in the next elections cycle. However, it is not just enough to demand that eligible voters register for their PVCs. It is pertinent that far-reaching electoral and judicial reforms are undertaken to ensure electoral integrity, strengthen public confidence, and promote judicial independence. Over time, the quality of our elections has continued to depreciate with voter turnout at an all-time low during the 2023 elections. Of the total 93.47 million registered voters, only 24.9 million persons voted in the last presidential and National Assembly elections. This represents a meagre 26.72 per cent voter turnout, the lowest since the return to democracy in 1999.

There should be an amendment in the 2022 Electoral Act, providing for: First, mandatory use of BVAS for accreditation of voters and upload of election results from all the polling units and collation centres across Nigeria without any provision for discretion to the Independent National Electoral Commission (@inecnigeria) for manual accreditation of voters. Second, mandatory electronic transmission of election results from the polling units to the iREV without any provision for discretion to the Independent National Electoral Commission for manual transmission of election results. Third, collation of results at the Ward Collation Centers on the basis of the results already electronically transmitted to the iREV from the polling units without any provision for manual collation of results at the Ward Centers. Fourth, collation of results at the Local Government or Area Council Collation Centers on the basis of the results already electronically transmitted to the iREV from the Ward Collation Centers without any provision for manual collation of results at the Local Government or Area Council Centers.

Fifth, collation of results at the State Collation Centers on the basis of the results already electronically transmitted to the iREV from the Local Government Collation Centers without any provision for manual collation of results at the State Center. Sixth, collation of results at the National Collation Center on the basis of the results already electronically transmitted to the iREV from the State Collation Centers without any provision for manual collation of results at the National Council Center. Seventh, at no point shall manual accreditation of voters, transmission of results, and collation of results be allowed. Eight, the position of the Chairman of INEC, Resident Electoral Commissioners, and the National Electoral Commissioners shall be subjected to a democratic voting by the people. Ninth, INEC to prove substantial compliance with the provisions of the Electoral Act and the Constitution in the conduct of the election in an election petition and not the petitioner. -AA

This afternoon, I received a delegation of young Nigerians led by Pastor Ukpola O. Chinedu from the Nigeria Electoral Reform Coalition (NERCO). I could relate to the urgency in their demands that the National Assembly amend the current electoral act to make electronic transmission of results from polling units mandatory. They are deeply worried that the current Act, which left the mode of transmission of results at the discretion of INEC, negatively impacted the 2023 general elections. They informed me that the group is not only pressuring the National Assembly on mandatory electronic transmission of results but also on taking the powers of appointing INEC officials from the President, vesting it on a transparent recruitment process by citizens. These efforts, they said, are aimed at demanding that every vote counts in our elections. I agree with the group that demanding transparent and credible elections is the way to go.

President Tinubu and his administration must resist any temptation to turn institutions of the Nigerian state into instruments of partisan advantage. The police belong to Nigeria. The military belongs to Nigeria. INEC belongs to the Nigerian people. None of them belongs to the APC. And let nobody misunderstand our demand for peaceful elections as weakness. We are asking only for what the Constitution and democracy guarantee every Nigerian: the freedom to vote and the right to have that vote count. If our institutions cannot conduct a free, fair, peaceful and transparent election in one state, Nigerians will legitimately ask what confidence they should have in the general election next year. The world is watching Osun. Nigerians are watching. History is taking notes. So my message to INEC, the security agencies and the Tinubu administration is simple: Let the people vote. Let every vote count.

And let the will of the people prevail. THREE THINGS I ASK OF YOU But my young friends, there is something government cannot do for you. Nobody can hand political power to a generation that is unwilling to organise for it. So when you leave this summit, I want you to remember three words: REGISTER. ORGANISE. LEAD. Register, because millions of Nigerians have become cynical about politics and elections. Some believe their votes will not matter. Your assignment is to persuade them that surrendering their vote guarantees that somebody else will decide their future. Go into your campuses, communities, markets and workplaces. Use the digital spaces where your generation already lives. Encourage eligible Nigerians to register and encourage those who are registered to participate. But registration without organisation will achieve little. Anger is not an organisation. A hashtag is not an organisation. Complaining on social media is not an organisation.

● Make electronic transmission of results mandatory from polling units to prevent tampering ● Introduce electronic collation systems for higher-level aggregation to eliminate manual manipulation ● Mandate the real-time upload of Form EC8B and other result sheets for public verification ● Limit result aggregation to the ward level, ensuring transparency and reducing opportunities for interference at higher levels ● Establish an Electoral Offences Commission to investigate and prosecute electoral crimes independently ● Create an Office of the Independent Chief Elections Auditor under the Commission to audit election materials before voting, monitor the process before final declaration, and conduct post-election audits for accountability ● Require the use of body cameras for all election officials and security personnel on election duty to ensure transparency and deter misconduct 47
